Terms of Service

1. Acceptance of Terms

By accessing or using Momentum ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Momentum is an action-to-outcome tracking application designed for developers. The Service provides project management, task tracking, GitHub integration, AI-powered recommendations, and gamification features. The Service is provided via a web application and may be updated, modified, or discontinued at our discretion.

3. User Accounts

Registration

To use the Service, you must create an account using a valid email address or a supported OAuth provider (Google, GitHub). You agree to provide accurate and complete information during registration.

Account Security

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

Account Termination

You may delete your account at any time through the account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users.

4. User Content

You retain full ownership of all content you create within the Service, including projects, goals, tasks, notes, and other data. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for the content you create and share through the Service. You agree not to upload content that is illegal, harmful, or infringes on third-party rights.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use automated tools, bots, or scrapers to access the Service without our prior written consent
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Impersonate another person or entity, or misrepresent your affiliation
  • Use the Service to transmit spam, malware, or other harmful content
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Third-Party Integrations

The Service integrates with third-party platforms including GitHub and Google. Your use of these integrations is subject to the respective terms of service of each platform:

  • GitHub— subject to GitHub's Terms of Service. We access repository and commit data with your explicit authorization.
  • Google— subject to Google's Terms of Service. Used for optional authentication only.
  • AI Features— powered by the Anthropic Claude API. Limited project metadata may be processed to generate recommendations. Anthropic does not use this data to train models.

We are not responsible for the practices or policies of third-party services. You may disconnect integrations at any time from your account settings.

7. Intellectual Property

The Momentum name, logo, visual design, and underlying source code are the property of Momentum and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our express written permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Momentum and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us (if any) during the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Momentum and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Material changes will be communicated via email or a prominent notice within the application. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Momentum operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
